Mediation and Arbitration - Alternative dispute resolution (ADR)
Mediation
Mediation is a form of Alternative Dispute Resolution which is often used in relation to family law cases. Mediation is when two parties who are going through separation and/ or divorce decide to choose a neutral third party to help them reach a mutual agreement. This method is an effective form of resolution when it comes to handling cases involving custody and access to children, division of property, and spousal and child support.
Arbitration
Arbitration is another form of Alternative Dispute Resolution. It is similar to mediation in that it must be agreed to by both parties, however, if you and your partner cannot reach a resolution, your arbitrator decides your issues. Their decision is called a family arbitration award. This award is legally binding.
