In accordance with section 29 the Family Law Act, you may meet the definition of a spouse even if you are not legally married if you meet any of the following criteria:
- Two individuals who are legally married to one another
- Two individuals who have entered a marriage that was never or can never become valid (void) or a marriage that can only be valid if an annulment isn't provided within a given amount of time (voidable)
- Two individuals who are not married, however, have been cohabiting with one another for an extended period (3 years or more)
- Two individuals that have cohabited for a given amount of time and are either adoptive or biological parents of children
